WHEREAS, Title I of P.L. 104-333 authorizes the Presidio Trust to adopt and to enforce such rules and regulations as may be necessary and appropriate to carry out its duties and responsibilities; and
WHEREAS, the staff of the Presidio Trust have drafted the Regulations provided herewith, with direction from members of the Presidio Trust Board of Directors, and in consultation with the Secretary of the Interior and his designees; and
WHEREAS, pursuant to Title I of P.L. 104-333, on July 1, 1998, the Presidio Trust will assume administrative jurisdiction of the entire property designated as Area B on the map entitled Presidio Trust Number 1, dated December 7, 1995; and
WHEREAS, it is necessary and appropriate for the Presidio Trust to have these Regulations in effect prior to the time that it assumes administrative jurisdiction of this property in order to carry out its duties and responsibilities under the law; and
WHEREAS, it has not been possible for the Presidio Trust to provide for public comment on these Regulations before they must become effective;
NOW, THEREFORE, BE IT RESOLVED, that the Presidio Trust hereby adopts the Regulations provided herewith as final interim regulations, to be effective immediately upon adoption; and
BE IT FURTHER RESOLVED, that pursuant to the Administrative Procedure Act, 5 U.S.C. § 553(d), the Presidio Trust finds good cause for the adoption and effectuation of these Regulations as final interim regulations prior to the provision of opportunities for public comment; and
BE IT FURTHER RESOLVED, that the Presidio Trust Board of Directors directs the Executive Director, in consultation with the General Counsel, to take such steps as may be necessary to have these Regulations (including such non-substantive changes as may be necessary thereto) published in the Federal Register forthwith as final interim regulations, together with a preamble describing their import; and
BE IT FURTHER RESOLVED, that the Board of Directors directs the Executive Director, in consultation with the General Counsel, to take such steps as may be necessary to provide an opportunity for 60 days of public comment on these final interim regulations, to consider such comments, and to prepare final regulations for the Board of Directors consideration.
